SEATTLE (BRAIN) — Rad Power Bikes dropped its lawsuit filed against an Arizona electric vehicle company on Wednesday that sold e-bikes under the Bam Power Bikes brand.
A Rad Power Bikes spokeswoman said the company dismissed the case after the Banm Power Bikes' website was taken offline and copyright infringements were removed.
In addition to the copyright infringements, the lawsuit filed in April stated Bam Power infringed on Rad Power's designs on its website. Bam Power, owned by JHR Electric Transport, also was accused of making false advertising claims. It did not file responses to the complaints with the court.
The alleged copyright infringements included Rad's bike measurements graphic on its website, its homepage tagline, "Built for Everything, Priced for Everyone" (which was repeated exactly on the Bam homepage), and other website elements, including its customer review page and consumer-direct pricing page.
Rad Power claimed that Bam Power misled customers through false association and advertising, and by claiming to have patented technology that, Rad claimed, can't be found.
The case was filed in the U.S. District Court for the Western District of Washington in Seattle.
